Court orders FIR against cop, 2 others for cheating

New Delhi, Aug 17 (PTI) A court here has directed DelhiPolice to lodge an FIR against a head constable and two othersfor carrying out unauthorised construction in a property ownedjointly by the complainant and the cop. "Investigation is required to ascertain the truth of thematter… SHO of Jaitpur police station is directed to lodgeFIR under relevant provisions of law on the complaint of therevisionist and investigate the matter," Additional SessionsJudge (ASJ) Raj Kumar Tripathi said. The court asked the police to lodge FIR against HeadConstable Mahesh Sharma and his two brothers Ajay and Manoj onrevision plea of complainant Angad Sharma against the order ofa magisterial court which had dismissed his plea against themfor forging documents and beating him up. "Revisionist has levelled serious allegations against therespondents in his complaint which are required to be investigated by the police," the ASJ said. According to the complaint, Angad, along with the headconstable, had purchased a property in Hari Nagar extension inWest Delhi in 2010 for Rs 14.85 lakh for the purpose ofinvestment, but soon the cop started residing in it withouthis consent. It was alleged that in 2015, the cop, without informingor discussing with the complainant, demolished the property,began carrying out unauthorised construction and transferredthe electricity meter in the name of his brother Manoj. The complainant approached the police but to no avail, itsaid, adding that he also clicked pictures of the propertysite from his mobile phone as evidence against them but he wasbeaten by the accused cop’s brothers and framed in a falsecase of molestating the constable’s wife. Angad approached a magisterial court for lodging of FIRagainst the accused but his plea was dismissed. He then moved a revision plea before the sessions courtseeking FIR against the accused, saying probe was required inthe case to recover his mobile phone which was allegedlysnatched and the source of forgery of documents of theproperty was to be found out. He had sought registration of FIR under sections 323(voluntarily causing hurt), 341 (wrongful restraint), 356(assault in attempt to commit theft), 506(threatening), 420(cheating), 467/468/471(forgery) and 120B(criminal conspiracy)of the IPC.
