Holding only men accountable for adultery is violation of equality: SC

A five-judge bench on Wednesday said that only holding men accountable for Article 14 that is adultery is not fair as it violates the equality.

The CJI-led bench said, “If adultery gets scrapped as a crime for violating Article 14, then no one, neither the man nor the woman, will be punished. Adultery can be ground for divorce and other civil consequences.” The hearing will continue on Thursday.

“Section 497 of the IPC supports, safeguards and protects the institution of marriage,” the centre said. It also added that decriminalisation of adultery will lead to weakening the sanctity of marriage and the marital bond.
