Rahul Gandhi Moves Gujarat HC Seeking Stay On Conviction In ‘Modi Surname’ Case

New Delhi: Congress leader Rahul Gandhi moved to Gujarat High Court against the lower court’s order that rejected the stay on his conviction in connection to the criminal defamation case over the ‘Modi Surname’ remark.

Earlier, the Surat court on April 21 rejected Rahul Gandhi’s plea to stay on the conviction that would help him get reinstated as an MP. Earlier, the Congress leader was disqualified from Lok Sabha following a two-year jail term in connection with the defamation case.

In his judgement, Additional sessions judge Robin P Mogera had cited Gandhi’s stature as an MP and former chief of the country’s second-largest political party and said he should have been more careful.

He cited prima facie evidence and observations of the trial court and said it transpires that Gandhi made certain derogatory remarks against Prime Minister Narendra Modi apart from comparing people with the same surname with thieves.

Rahul Gandhi was disqualified after a lower court in Surat sentenced him to two years in jail on March 23 under sections 499 and 500 (defamation) of the Indian Penal Code (IPC) in a case filed by Purnesh Modi.
