The Supreme Court on Monday questioned the Delhi government on its failure to enforce the firecracker ban aimed at reducing air pollution during Diwali. A bench comprising Justices Abhay S Oka and Augustine George Masih highlighted that media reports indicated widespread disregard for the ban and requested an immediate explanation from the Delhi authorities.
The court directed the Delhi government to file an affidavit outlining the measures taken to control pollution and ensure compliance with the firecracker restrictions. Additionally, the bench asked why the Delhi Police had not enforced the ban effectively and issued a notice to the Delhi Police Commissioner regarding the apparent non-compliance.
“We want the Delhi government to immediately respond as to why this has happened. We will simultaneously issue notice to the Delhi Police Commissioner as to why there is non-compliance. We have to hear this immediately,” the bench stated.
The court also urged Delhi authorities to consider a perpetual ban on firecrackers in the national capital to prevent similar issues in the future. “Delhi government and other authorities must also take a call on the perpetual ban of these firecrackers,” the bench ordered, requesting that affidavits from both the Delhi government and Police Commissioner be submitted within a week.
The bench further asked the governments of Haryana and Punjab to provide data on stubble-burning incidents reported during the last ten days of October, as the hearing also addressed the broader issue of air pollution in the Delhi-NCR region.
