Excise Policy Case: ED Files Written Submissions Before Delhi HC Opposing Any Relief To Kejriwal

Date:

New Delhi: The Enforcement Directorate (ED) on Monday submitted written objections to the Delhi High Court, firmly opposing any relief for Delhi Chief Minister Arvind Kejriwal in connection with the Excise Policy money laundering case.

TOP POINTS

  • ED argued before the Delhi High Court that the trial court’s order granting bail to Delhi Chief Minister Arvind Kejriwal should be stayed and set aside. ED contended that the vacation judge had made perverse findings in nearly every paragraph of the order, both on factual matters and legal aspects.
  • The ED further emphasised that the judge had not thoroughly examined the prosecution’s evidence placed on record.
  • ED further stated that new material collected against Arvind Kejriwal post 2023 was not considered by vacation judge. Enforcement Directorate lists statements of 13 Angariyas, Goa AAP workers, and AAP office bearers as new statements.
  • The Supreme Court on Monday adjourned for June 26 the plea of CM Kejriwal challenging the order of the Delhi High Court granting interim stay on bail to him in the Delhi excise policy case probed by the Enforcement Directorate (ED).
  • A vacation bench of Justices Manoj Misra and SVN Bhatti observed that the decision of the High Court to grant an interim stay on Kejriwal’s bail without passing a final order in the matter was “unusual”.
  • Earlier on June 21, the High Court ordered the grant of an interim stay on the trial judge bail to Kejriwal in the money laundering case while reserving its order and asked both sides to file their written submissions until Monday. The ED challenged the trial court’s decision to grant bail to Kejriwal, describing the order as both illegal and perverse.
  • Kejriwal was arrested by the ED on March 21 in connection with a money laundering case relating to alleged irregularities in the now-cancelled Delhi excise policy 2021-22.
