For applicants seeking green cards through the EB categories, these dates indicate the earliest a visa can be issued or an adjustment of status application approved.
Employment-Based Visa Cutoff Dates for December
EB-1 (Priority Workers): For India, the Final Action Date remains set at February 1, 2022, with no change from the previous month.
EB-2 (Advanced Degree Professionals): India sees a slight advancement by two weeks to August 1, 2012.
EB-3 (Professionals and Skilled Workers): India’s cutoff date moves forward by one week, now set at November 8, 2012.
EB-3 (Other Workers): India’s date advances by one week, aligning with EB-3 Professionals at November 8, 2012.
EB-5 (Immigrant Investors): In the EB-5 Unreserved categories, cutoff dates remain static, with India at January 1, 2022. The EB-5 set-aside categories, including Rural, High Unemployment, and Infrastructure, are current across all countries.
Meanwhile, the Dates for Filing chart remains unchanged from November.
The U.S. Citizenship and Immigration Services (USCIS) is expected to announce shortly whether it will accept adjustment of status applications for December based on the Final Action Dates chart or the Dates for Filing chart.
Applicants are advised to monitor the USCIS Visa Bulletin web page for updates on which chart will be applicable, as this will determine the eligibility to submit their adjustment applications.
