Fact Check: Did President Kovind Pass An Ordinance To Award Death Penalty To All Rapists? Here’s The Truth

A post is going viral on social media with a claim that President Ram Nath Kovind has recently passed an Ordinance mandating death penalty for every rape convict.

“अब हर बलात्कारी को मिलेगी फांसी, राष्ट्रपति ने अध्यादेश को मंजूरी दी!! अब होगा सही न्याय!! राष्ट्रपति जी आपके इस आदेश का हम सब स्वागत करते है ।” the post read.

(Translation: Now every rapist will be hanged, President approved the ordinance!! Now the right justice will be done!! Mr President, we all welcome your order)

FACT CHECK 

NewsMobile fact-checked the post and found the claim to be false.

Firstly, we search for media reports on the same and found multiple reports from 2018 stating that ‘President Ram Nath Kovind approved Ordinance awarding death penalty for child rape.’ The media reports can be seen here, here and here.

According to the report, on April 22, 2018, ‘President Ram Nath Kovind gave assent to the Criminal Law (Amendment) Act, 2018, that provides for stringent punishment, including the death penalty for those convicted of raping girls below the age of 12 years’.

The new act came into being after incidents of rape of minor girls came to light from different parts of the country including Kathua in Jammu. Under the Criminal Law (Amendment) Act, 2018, provision for severe punishments for rape convict were added, especially in cases where the victim is a minor.

The Act also amended the Indian Penal Code, Indian Evidence Act, 1872, the Code of Criminal Procedure, 1973 and the Protection of Children from Sexual Offences Act, 2012, providing stringent punishment to rape convicts of minors.

However, nowhere in the act did we find any clause stating that ALL rape convicts will be awarded capital punishment. 

We also searched for any such recent announcement on the official government websites and social media handles but did not find any ordinance on the same.

We also searched the social media handles of the National Commission for Women and Ministry of Women and Child Development but no such announcement was present.

Hence, from the above information, it is clear that the post in circulation is false. An ordinance for rapists of minors has been attributed to cover all cases of rapes in the viral claim, which is misleading.
