New Delhi: The Tis Hazari court on Monday, denied bail to Bibhav Kumar, the former PA of Delhi Chief Minister Arvind Kejriwal, in the AAP Rajya Sabha MP Swati Maliwal assault case. Maliwal, who was present at the hearing, opposed the bail plea, saying she was receiving threats.
Additional Sessions Judge Sushil Anuj Tyagi reserved the order following the conclusion of submissions made by senior advocate N Hariharan representing the accused, additional public prosecutor Atul Srivastava, and advocate Madhav Khurana, who is representing Swati Maliwal.
During the proceedings, senior advocate N Hariharan contended that the bail application is admissible in this court, asserting that it holds jurisdiction to hear such matters. He pointed out that the FIR invokes section 308 of the Indian Penal Code, which falls under the jurisdiction of the sessions court.
Advocate Hariharan further argued that the complainant’s actions, including visiting the Chief Minister’s residence and attempting to contact PA Bibhav Kumar, were conducted without permission or prior appointment, emphasizing the circumstances surrounding the case.
Kejriwal’s former PA was arrested in connection with the alleged assault on Maliwal. He was produced before the Tis Hazari Court, which remanded him to police custody for five days.
Maliwal, in her complaint, alleged that Bibhav “slapped” her “at least seven to eight times” while she “continued screaming” and “brutally dragged” her while “kicking” her in her “chest, stomach and pelvis area.”
After his arrest, Bibhav was produced before Delhi’s Tis Hazari Court, which remanded her in police custody for five days. Bibhav lodged a counter-complaint with the police on Friday, accusing Maliwal of gaining ‘unauthorised entry’ into the CM’s Civil Lines residence and ‘verbally abusing’ him.
