New Delhi: The Delhi High Court on Wednesday issued an order that bans Chinese device manufacturer OnePlus from importing, marketing and selling its flagship device in India.
The news comes, sadly enough, on OnePlus’ first anniversary. Domestic brand Micromax complained to the High Court in the capital that OnePlus was infringing on its country-specific exclusivity agreement with Cyanogen, whose OS will feature on Micromax’s YU brand of devices, which is slated to launch on Thursday.
According to the court order, Indian handset manufacturer, Micromax has been granted an injunction as the OnePlus One infringes its exclusive right to have the Cyanogenmod ROM in India. OnePlus One, however, is allowed to clear its existing stock in India. For the initial sale, OnePlus only brought 20,000 units to India.
Earlier in the month, controversy over the Micromax’s exclusive deal with Cyanogenmod flared up. OnePlus One is perhaps the first smartphone to use Cyanogenmod, and has received adulation because of the ROM and its hardware.
As per Micromax’s exclusive deal with Cyanogen, its incoming Yu smartphone line will be exclusively powered by Cyanogenmod in India. This meant that the OnePlus One by default was infringing Micromax’s exclusivity.
After the announcement of the deal between Micromax and Cyanogen, OnePlus announced that its phones in India will not receive an update to Cyanogenmod. Instead, it is working on a separate Android Lollipop-based ROM, which will replace Cyanogenmod on its existing hardware in India.
