"The claim of the petitioner is totally vexatious anddoes not fall within the legal ambit and by no stretch of theimagination, the claim of the petitioner can be justified. "The petition is not maintainable in as much as section37 of the Government of National Capital Territory of DelhiAct, 1991 provides that the courts cannot inquire into theproceedings of Legislative Assembly and no officer or memberof Legislative Assembly in whom powers are vested by or underthe Act," the government added. Earlier also Sharma had sought the court’s permission toallow him to take part in a two-day special session held inJune. The AAP government had told the court that Sharma has not"regretted" on what he had said about Lamba. Referring to a report of an Ethics Committee of the Delhiassembly on the issue, the government had said that Sharma wasgiven chances to express regret on his remarks but hadrefused. The Ethics Committee had "unanimously" recommendedstripping Sharma of his assembly membership for his remarksagainst Lamba and being "unrepentant" about it.
