Nirbhaya case: SC dismisses petition of Vinay Sharma

The Supreme Court on Friday dismissed the petition of Vinay Sharma, one of the four convicts in the brutal case of gangrape and murder of Nirbhaya.

He had challenged the rejection of his mercy petition by the President of India.

The Court also rejected the petitioner-convict’s plea that stated that he was mentally unstable and hence could not be hanged.

The bench headed by Justice Banumathi pointed out to the certificate issued by a medical professional after thoroughly examining the accused and disagreed with the condition stated by Sharma.

The law specifically prohibits executing death sentences on those who are physically and mentally ill, minor children (below 18) and pregnant women.

The apex court has step by step ensured that the convicts who were seen to be delaying the execution, avail all available legal remedies before them.

A Delhi Court on Wednesday permitted another convict Mukhesh to avail free legal support and provided him a list of empanelled lawyers to choose from.

The same court on Thursday, adjourned the matter seeking fresh execution of death warrants against the accused as all legal remedies are yet to be exhausted.

The tactics adopted have been severely criticized by the Supreme Court and the Union government has also filed a petition in the Supreme Court seeking clarity and urging the Supreme Court to fix a time limit for all capital punishments cases to avail their legal remedies.
