Bombay High Court Grants Bail To Anil Deshmukh In Money Laundering Case

Date:

The Bombay high court granted bail to former Maharashtra minister and Nationalist Congress Party (NCP) leader Anil Deshmukh on Tuesday in a money laundering case registered by the Enforcement Directorate.

The bail was granted on a surety amount of ₹1 lakh and the bail order will be effective from October 13 to enable ED to file appeal before Supreme Court.

The apex court noted that Deshmukh’s bail plea is pending in the High Court since March 21 and observed that keeping bail applications pending for eight months is not in accordance with the jurisprudence of bail.

Justice NJ Jamadar pronounced the order at 2.30 pm on Tuesday.

“We have held that first two components of credit in the Trust do not form proceeds of crime. Third component depends on statement of (dismissed Mumbai cop) Sachin Waze which in the discussion falls in favour of the applicant (Deshmukh). Apart from this, the applicant is also given the benefit under the proviso under Section 45 of the Prevention of Money Laundering Act (PMLA),” the judge stated.

Deshmukh will, however, continue to be lodged in judicial custody in Arthur Road prison since he is also being investigated by the Central Bureau of Investigation (CBI) in the corruption case.

The Court on September 28 reserved the order on the bail plea of former Maharashtra minister Anil Deshmukh in a money laundering case. Earlier on September 26, the Supreme Court directed the Bombay High Court to hear and decide expeditiously on the bail plea of Maharashtra’s former Home Minister Anil Deshmukh, who was arrested in connection with a money laundering case.
