Muzaffarpur shelter rapes: Enough is enough, says SC, transfers case to a Delhi court

Supreme Court on Thursday ordered the transfer of the Muzaffarpur shelter home rape case from Bihar to a court in New Delhi.

It came down heavily on the Central Bureau of Investigation (CBI) and the central government for transferring a CBI officer probing the Muzaffarpur shelter home case despite the Court’s embargo against the transfer of investigating officials.

The apex court transferred the trial of Muzaffarpur shelter home case to Saket POCSO Court, Delhi from Patna. The Court has ordered the judge to commence the trial in 2 weeks and complete it within a period of 6months.

While slamming the Bihar government for its management of shelter homes, the Supreme Court said, “Enough is enough. Children cannot be treated like this.”

The case relates to the alleged sexual abuse and assault of more than 40 minor girls over a period of time in the shelter home run by Brajesh Thakur’s state-funded non-governmental organisation (NGO).

Subsequently, the NGO was blacklisted and the girls were shifted to other shelter homes in Patna and Madhubani.

The case came to the fore following an audit report filed by the TISS.

In earlier hearings, the SC said that affidavits filed by the TISS and the of the Chief Secretary of Bihar depict horrifying details of sexual abuse in shelter homes in Bihar.

The shelter home case was uncovered in May 2018 after a report filed by the Tata Institute of Social Sciences (TISS) in April revealed that the inmates were allegedly sexually abused, after which 11 employees of the shelter home were arrested and 44 girls were rescued.

An FIR was lodged against 11 people, including Thakur, on May 31.

The probe was later taken over by the CBI.
