MACT awards Rs 15L compensation to kin of deceased woman

New Delhi, Aug 29 (PTI) Family members of a 30-year-oldwoman, who died after being hit by a DTC bus, have beenawarded over Rs 15 lakh by a Motor Accidents Claim Tribunalhere. The tribunal directed United India Insurance CompanyLimited, insurer of the offending vehicle, to pay Rs 15,96,400to the husband and two kids of the victim Sunita, who waskilled in the mishap after the bike on which she was a pillionrider and holding her minor kid, was hit by the bus. The tribunal also directed the insurance company to payRs 10,000 each to the brother-in-law, who was driving thebike, and the victim’s minor daughter, who were also injuredin the accident. While deciding the petition in the victim’s favour, thetribunal relied upon her post-mortem report, FIR and the siteplan of the accident and held that the biker was notnegligent. "The position of the bus has been shown in the site planin such a manner that on the turning, it came in the middle ofthe road and hit the motorcycle, though the motorcyclewas on its proper side," the tribunal observed. "…it is established that Sunita succumbed to injuries and Kishan and Kiran (other two victims) sustained injuries ina road accident on June 13, 2015 at Bhati Mines Road nearHanuman Mandir Mor due to rash and negligent driving of the DTC bus," the tribunal said. According to the complaint, the accident occured on June13, 2015 when the bus hit the bike from front, causing thedeath of Sunita and injuring the two. The claim of the respondents – DTC authority, driver andinsurance company – that the petitioners had filed a falsecase, was rejected by the tribunal. PTI RRT AGARC
