Fact Check: No, There Is NO Article 30(A) In The Indian Constitution That Says Bhagavad Gita Can’t Be Taught In School

After the Gujarat government announced that the Bhagavad Gita will be a part of the school syllabus for Classes 6 to 12th, a post started making rounds on social media claiming that according to Article 30(A) of the Indian constitution, the Bhagavad Gita cannot be taught in schools.

The post read, “कितने लोग चाहते है की अब धारा 30A हटा देनी चाहिए… जिससे स्कूलों में वेद, उपनिषद, गीता और रामायण जैसे ग्रंथ पढ़ाए जा सके।”

NewsMobile fact-checked the above claim and found it to be false.

Article 30 of the constitution talks about the Right of minorities to establish and administer educational institutions. 

Moreover, there is NO sub-clause as 30(A) under Article 30.

Here’s what Article 30 (page 14 of the pdf) says;

  • (1) All minorities, whether based on religion or language, shall have the right to establish and administer educational institutions of their choice.
    (1A) In making any law providing for the compulsory acquisition of any property of an educational institution established and administered by a minority, referred to in clause (1), the State shall ensure that the amount fixed by or determined under such law for the acquisition of such property is such as would not restrict or abrogate the right guaranteed under that clause
  • (2) The State shall not, in granting aid to educational institutions, discriminate against any educational institution on the ground that it is under the management of a minority, whether based on religion or language.

The above information proves that the viral claim is false as Article 30(A) does not say anything about teaching Bhagavad Gita.
